Snap Mortgage Terms of Service
Effective 2026-09-11.2 · Version 2026-09-11.2
1. About these Terms
These Terms govern your access to Snap Mortgage and its associated workspace, borrower, and account services (the “Services”). Snap Mortgage is operated by Think Whale LLC. “Snap Mortgage,” “we,” “us,” and “our” refer to Think Whale LLC. By creating an account or using the Services, you agree to these Terms. If you use the Services for a business, you represent that you are authorized to bind that business, and “you” includes that business. If you do not agree, do not use the Services.
A separately signed agreement with us controls if it expressly conflicts with these Terms. Your use of third-party products is also subject to the applicable provider’s terms.
2. Eligibility and account security
You must be at least 18 and legally able to enter an agreement to create an account. Provide accurate account information and keep it current. Protect your credentials, use available security controls, and notify us promptly through the Services’ support channel if you suspect unauthorized access. Do not share an individual account or use another person’s credentials.
You are responsible for actions you authorize through your account. Workspace and company administrators control access within their assigned authority. Access may change when your relationship with a workspace or organization changes. Billing responsibility does not itself grant access to operational records.
3. What the Services provide
The Services provide software for mortgage-related workflows, including account and workspace management, borrower information collection, contacts, applications, collaboration, communications, reporting, and supported integrations. Availability depends on your subscription, permissions, organization settings, and enabled providers.
Software output is not a commitment to lend, a loan approval, a rate lock, an appraisal, or legal, tax, investment, or underwriting advice. A lender’s separate agreements and disclosures govern its products and decisions. Rates, estimates, eligibility results, and property information may change and require verification. Do not represent a preliminary result as a final approval or guarantee.
4. Your responsibilities
Use the Services only for lawful, authorized purposes. You are responsible for your licensing, professional obligations, required disclosures, recordkeeping, and compliance with laws applicable to your business and communications.
Before providing another person’s information, obtaining a consumer report, contacting a recipient, or using an integration, obtain the authority, notices, and consents required for that activity. A subscription, uploaded contact, or successful connection test does not establish a permissible purpose to obtain credit information or permission to send marketing messages.
Do not bypass access controls, probe other tenants’ records, misuse recovery mechanisms, interfere with availability, upload malicious content, impersonate another person, or use the Services to discriminate unlawfully. Do not resell or make the Services available to unauthorized users. Do not remove proprietary notices or reverse engineer the Services except where applicable law expressly permits it.
5. Your content and sharing
As between you and Snap Mortgage, you retain your rights in information, documents, images, and other content you provide. You grant us permission to host, process, transmit, display, and otherwise use that content as necessary to provide, secure, support, and maintain the Services and carry out your authorized instructions. This permission does not transfer ownership of your content to us.
Only submit content you have the right to provide. Review recipients and permissions before sharing. Public profiles, published links, and other content you intentionally publish may be accessible outside your workspace and copied by others. Saving changes to a public profile can update its public content immediately.
An organization may retain records you created for it after your access ends. Removing your account does not necessarily remove records another customer lawfully controls or records subject to retention requirements.
6. Subscriptions, payment, and cancellation
Paid features require an applicable subscription or usage purchase. The checkout, order, or billing screen identifies the price, billing frequency, trial terms, and applicable taxes before you purchase. You authorize the selected payment method to be charged according to those terms, including recurring renewal charges unless you cancel.
Unless the purchase terms state otherwise, subscriptions renew at the end of each billing period. A trial converts to paid service only as described at checkout. Cancel through the available billing controls before the next renewal to prevent the next recurring charge. Cancellation timing and the end of paid access are shown in billing. Stopping use does not itself cancel a subscription.
You remain responsible for charges incurred before cancellation and authorized usage charges. Refunds and credits are governed by the terms disclosed at purchase, any separate agreement, and applicable law. We may restrict paid features for unpaid amounts after applicable notices or grace periods. Cancellation does not itself delete business records.
We will disclose material price or renewal changes before they apply as required by applicable law. A billing change does not itself authorize a change to workspace access or record ownership.
7. Integrations and third-party services
You decide whether to connect supported third-party services and provide the necessary authority and credentials. You authorize the exchanges needed for the actions you request. Check the provider’s terms and privacy notices before connecting it.
A saved configuration or locally validated credential is not proof that a provider has accepted a request or that every provider function is available. Providers may impose fees, eligibility conditions, limits, outages, or additional agreements. We do not control their services, independent decisions, or data practices. Disconnecting an integration does not necessarily delete data already transmitted to that provider.
8. Automated and AI-assisted features
Some enabled features use automated processing or AI to help summarize information, extract document content, or prepare suggested work. Outputs can be incomplete, outdated, or incorrect. Review source records and verify outputs before relying on them or sharing them with others.
AI assistance does not replace professional judgment and must not be used as an autonomous lending, underwriting, or other legally significant decision-maker. Access and organizational policy continue to apply to AI features. Do not submit information you are not authorized to process through the selected feature.
9. Privacy and confidentiality
Our Privacy Policy describes how we handle personal information in connection with the Services. Your organization may have additional privacy notices and obligations governing records it controls. These Terms do not replace a lender’s required financial privacy notice, consumer-report authorization, communication consent, or a separate data-processing agreement.
Use available access controls to protect confidential information and disclose it only to authorized recipients. We may process information to investigate misuse, respond to lawful requests, resolve disputes, and protect the Services, subject to applicable law and our contractual obligations.
10. Ownership of the Services
We and our licensors retain rights in the Services, software, design, and associated intellectual property, excluding your content. Subject to these Terms and your subscription, we permit you to use the Services for their intended purpose. No other rights are granted by implication.
If you provide suggestions, you permit us to use them to improve the Services without an obligation to compensate you. This permission does not authorize us to publish confidential customer records included with your feedback.
11. Changes, suspension, and termination
We may update the Services and change or discontinue features. We may suspend or limit access when reasonably necessary to address a security risk, unlawful activity, a material breach of these Terms, or unpaid charges. Where practicable and appropriate, we will give notice and an opportunity to resolve the issue. We may act immediately when delay would create risk or violate law.
You may stop using the Services and cancel paid service through the applicable billing process. Before access ends, arrange any permitted export you need. Data handling after termination remains subject to applicable law, the Privacy Policy, and any separate agreement. Provisions that by their nature should survive termination continue to apply.
12. Disclaimers and limitations
To the extent permitted by law, the Services are provided “as is” and “as available.” We do not guarantee uninterrupted availability, error-free operation, or the accuracy of information supplied by customers or third parties. We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the extent permitted by law.
To the extent permitted by law, neither party is liable under these Terms for indirect, incidental, special, consequential, or punitive damages, or lost profits arising from use of the Services. Our total liability arising from the Services is limited to the fees you paid us for the affected Services during the 12 months before the event giving rise to the claim. These limitations do not exclude liability that cannot lawfully be limited, or liability for fraud or intentional misconduct.
Nothing in these Terms limits non-waivable consumer rights or excuses payment obligations already incurred.
13. Changes to these Terms and contact
We may revise these Terms. We will provide notice of material changes through the Services or another appropriate channel and obtain additional agreement when required by law. Changes apply prospectively unless otherwise permitted by law. If you do not accept revised Terms, stop using the affected Services and cancel any applicable subscription.
For questions about these Terms, account access, or a dispute, contact Think Whale LLC at support@thinkwhale.com or by mail at:
Include enough information for us to identify the issue, but do not send passwords, full Social Security numbers, or complete payment-card details through ordinary email.
14. Text messaging terms
Snap Mortgage supports text communications from the lender to borrowers about their mortgage application and loan, including phone verification, requested follow-up, document requests, and status updates. The consent notice identifies the sender: Think Whale (Snap Mortgage) for platform forms, or the mortgage company for its own forms. Consent applies to the identified sender and does not authorize messages from every business using Snap Mortgage. Think Whale LLC operates Snap Mortgage.
Enrollment requires the affirmative consent process presented for the particular program. Accepting these Terms, creating an account, or providing a phone number alone does not enroll you in messaging or grant marketing consent. Consent is not a condition of purchase. Message frequency varies with your requests, activity, and the program described at opt-in. Message and data rates may apply according to your mobile carrier plan.
Reply STOP to the sending number to stop messages from that program. You may receive one opt-out confirmation. Reply HELP for help, or contact support@thinkwhale.com. For a mortgage business’s messages, you may also contact the identified business. Senders must not bypass an opt-out or re-enroll a recipient without valid renewed permission.
Group SMS/MMS requires each participant’s agreement to share their phone number and contributions with the other participants. Opting out does not remove copies already delivered or control independent messages from other participants. Do not text passwords, full Social Security numbers, payment-card details, or sensitive mortgage documents; use the designated secure channel.
Delivery depends on carriers and network availability. Carriers are not liable for delayed or undelivered messages. Texting is not an emergency service. The Privacy Policy linked on this page describes messaging data handling and protections for mobile information and consent records.
